These terms and conditions are subject to English law.
1. How to Order
1.1. Select the Goods you require from the Website, fill in any required fields, choose the quantity you’d like (the default will be one unit) and click 'Add to Cart'.
1.1.1. A quantity limit is set to ten units of Goods. To order quantities greater than ten, please contact our Merchandise team.
1.1.2. You can remove unwanted Goods from your shopping cart at any time.
1.1.3. Goods need to be bought in a separate transaction to digital products. Please remove any digital products from your shopping cart before attempting to purchase.
1.2. When you are ready to purchase, review your shopping cart, making sure all specifications such as size (see our size guide) and colour meet your requirements, then click ‘Checkout’.
1.2.1. If you are a new customer you will need to create a Customer Account to place an order.
1.2.2. If you already have a Customer Account, you will need to log in to place an order.
1.3. You will be directed to add your billing and delivery details and a delivery method and shipping charge will be calculated based on your delivery details.
1.4. You can then see your payment method (we use PayPal to process your payment), apply a valid Coupon Code and add any comments to your order.
1.5. Once you agree to these Merchandise Terms and Conditions, you can continue to view a summary of your order, including price breakdown and then confirm your order. By placing an order through the Website, you warrant that you are legally capable of entering into binding contracts.
1.6. You will then proceed to PayPal’s payment page, where you will need to log in or create an account to complete your order. Your payment will be collected via PayPal from you by INSYDIUM LTD.
1.7. Following submission of your Merchandise order, you will be sent an automated order confirmation to the email address set up on your Customer Account to confirm that we have accepted the order and a contract to purchase the ordered Goods then takes effect between you and INSYDIUM LTD.
1.8. When we have processed, packed and shipped your Merchandise order we will email you to confirm despatch.
2. Data protection and privacy
3.1. A description of the main characteristics of the Goods can be found on the Website. Whilst we try to be as accurate as possible, all Goods information is provided in Goods faith and subject to our Goods manufacturer’s specifications.
3.2. Goods imagery on the Website is for illustrative purposes only. Your Goods may vary slightly from the images shown on the website. Any pictured accessories are not included, unless stated in the specification of the Goods.
3.3. We have made every effort to display as accurately as possible the colours of our Goods that appear on this website. However, we cannot guarantee that your screen's display will accurately reflect the colour of the actual Goods.
3.4. If Goods are out of stock at the time of order, you should be notified in the shopping cart and unable to advance with the purchase. In the event of us not being able to fulfil your order because the Goods you’ve ordered are no longer available, we will inform you. We reserve the right to cancel the contract between us under this clause and a full refund will be processed as soon as possible.
4. Pricing, Taxes and Discounts
4.1. Prices for Goods on our Website exclude Value Added Tax (VAT).
4.2. VAT is calculated during checkout at the current rate, before your order is submitted. The amount will vary depending on the country of delivery and tax status.
4.3. The currency of Goods on our Website is clearly displayed.
4.4. Occasionally, Goods displayed on the Website may be incorrectly priced. If we discover an error in the price of the Goods you have ordered, we will inform you. We reserve the right to cancel the contract between us under this clause and a full refund will be processed as soon as possible. INSYDIUM LTD is under no obligation to sell incorrectly priced Goods to you at the incorrectly stated price.
4.5. Prices and discounts may vary and may only be available for limited periods. We reserve the right to withdraw or amend prices and discounts at our discretion.
4.6. Discount Coupon Codes have conditions which must be met in order to be valid. Promotional ‘Sale’ Coupon Codes only apply on specified Goods and during the period stated.
5. Delivery and Shipping Charges
5.1. Shipping charges are additional to the Goods price displayed on our Website and are calculated during checkout, before your order is submitted. The amount will vary depending on the country of delivery and the quantity of Goods ordered.
5.2. Where your delivery is within the EU, there should be no additional costs applied to your order on delivery. Where your delivery is outside the EU, your local Customs may apply Import Duty or other taxes to your shipment before releasing it to you. It is your responsibility to be aware of these costs and arrange payment and clearance directly with the relevant authorities.
5.3. To change the delivery address of your order (within the same country) before despatch, contact our Merchandise team. After despatch, we cannot change the delivery address.
5.4. We aim to deliver your order within 21 days of you placing it. If you have not received your order within this timescale, contact our Merchandise team.
5.5. If you would like to expedite your order, contact our Merchandise team.
5.6. Occasionally, for reasons beyond our control we may be prevented from delivering your order as planned. These reasons might include things such as severe weather, war or the default of our suppliers. We will try to deliver as soon as possible however we can’t be held responsible where this causes a delay or failure in delivering your Goods.
6. Cancellation and Returns
6.1. You have 14 days to cancel your order from the day after you receive it by contacting our Merchandise team. When you contact us, make it clear that you’d like to cancel your order and ensure to include your order number, name, delivery address and email address.
6.2. Once you have cancelled your order, you must return the Goods in an unused and re-saleable condition, including any tags and complementary gifts sent within 14 days of cancellation, complete with the original packaging. You must ensure that the Goods are packaged adequately to protect against damage and return to INSYDIUM LTD, Riverside, 79 Woodhead Road, Honley, HD9 6PP, United Kingdom.
6.3. You must pay for any return shipping costs, except where the incorrect Goods have been sent to you or the Goods are faulty.
6.4. Returns are at your own risk. For your protection, we strongly recommend that you return your Goods via registered post and ensure you have proof of shipping.
6.5. You have a legal obligation to take reasonable care of the Goods before they are returned to us, if you fail to comply with this, we reserve the right to reduce your refund to reflect the reduction in value.
6.6. We will refund you using the same payment method originally used to pay for the Goods. You will be refunded no later than 14 days after the day we receive the returned Goods, including basic outgoing shipping charges only, less any costs due under clause 6.5.
6.7. Once a refund has been processed, you will receive a confirmation email detailing the amount which has been refunded and the Goods we have received.
6.8. We don’t accept cancellations or returns after the periods stated above.
7. Faulty or Damaged Goods
7.1. Please check the order on delivery - any Goods found to be faulty or damaged should be reported to us within 30 days of receiving the order.
7.2. In the event that you receive faulty or damaged Goods, please contact our Merchandise team with details of the problem. Include your order number, name, delivery address, email address and let us know your preference of a refund or replacement, and, if possible also attach a digital photograph of the problem as this normally saves you having to return the Goods for inspection.
7.3. It is expected that Goods have been used in accordance with manufacturer instructions (available on the Website) at all times. No liability can be held for Goods used in ways other than for their stated purpose.
7.4. We will contact you and deal with the matter in accordance with your legal rights.
8. Missing or Incorrect Goods
8.1. Please check the order on delivery - any Goods found to be missing or incorrect should be notified to us within two days of receiving the order.
8.2. In the event that you are missing Goods from your order or have been sent incorrect Goods, please contact our Merchandise team with details. Include your order number, name, delivery address, email address and details of the Goods ordered.
8.3. We will contact you and deal with the matter in accordance with your legal rights.
